ACTION ALERT (12/16/2020):
ASK INDIANA’S LAWMAKERS NOT TO OVERTURN GOVERNOR HOLCOMB’S VETO OF EVICTION BILL SEA 148.
SUMMARY:
Last legislative session (2020), the Indiana House and Senate passed SEA 148. Governor Holcomb saw the harm in this bill and vetoed it. There is now concern that the General Assembly will try to overturn this veto during the 2021 Legislative Session.
ACTION:
Contact your legislators and urge them not to overturn the veto of SEA 148.

WHAT DOES SEA 148 DO?
- It bans Indiana cities from requiring tenants be provided information on their rights under law.
- It allows landlords to be awarded their attorney fees and damages, but winning tenants can only get one month’s rent.
- It will allow more types of tenant retaliation to occur when contacting the health dept or legal services due to decreased ability for cities to address these issues through fines.
- It adds more fuel to Indiana’s housing crisis, our eviction problems, and habitability problems.
MESSAGING—DEVELOPED BY OUR PEERS WITH DISABILITIES!
- SEA 148 directly harms tenants with disabilities. There are nearly 4 million housing discrimination complaints each year, with disability discrimination claims continually being a top cause.
- There is a critical lack of affordable, accessible, non-toxic, healthy, decent, safe, and integrated housing for our peers with disabilities. Preventing the creation of tenant bills of rights, further allows these problems to continue.
- Landlords need to be held responsible for discrimination against our peers with disabilities.
- SEA 148 places landlord profits over people, especially our peers with disabilities.
- People with disabilities desperately need access to education about their tenant rights. SEA 148 prevents access to information that our peers with disabilities need in order to achieve equity in housing.
COVID-19 MESSAGING:
- With COVID-19 creating harsh economic circumstances, our communities and peers with disabilities cannot afford less protections and more evictions. Our lives depend on having information about our rights and housing stability.
