Final approval of Indiana’s Home- and Community-Based Services Final Rule Statewide Transition Plan

The Indiana Family and Social Services Administration created a Statewide Transition Plan to assess compliance with the HCBS Settings Final Rule, which is effective March 17, 2023, and identify strategies and timelines for coming into compliance with the new rule as it relates to all FSSA HCBS programs. The FSSA, specifically the Division of Mental Health and Addiction, Division of Disability and Rehabilitative Services\Bureau of Developmental Disabilities, and the Division of Aging, are pleased to announce the approval of Indiana’s Home and Community Based Services Final Rule Statewide Transition Plan.

Indiana’s initial STP was submitted to CMS for review and approval in December 2014. In September 2016, FSSA submitted a third version of the STP incorporating site-specific assessment results for Indiana’s HCBS programs.

Upon receiving initial approval for completion of its assessment and outline of systemic remediation activities on Nov. 8, 2016, FSSA has worked diligently in making a series of technical changes requested by Centers for Medicare and Medicaid Service to achieve final approval.

FSSA addressed all issues and resubmitted an updated version on May 13, 2022. On June 3, 2022, CMS granted Indiana final approval of its Statewide Transition Plan to bring settings into compliance with the federal home and community-based services regulations found at 42 CFR Section 441.301(c)(4)(5) and Section 441.710(a)(1)(2).
